These Terms of Service (“Terms”) form a legally binding agreement between you (“User”, “you”, or “your”) and HostReady (“HostReady”, “Company”, “we”, “our”, or “us”), governing your access to and use of the HostReady platform, website, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
HostReady provides software tools that help short-term rental operators with regulatory awareness, compliance monitoring, and property-level compliance tracking. The Service may include automated insights, compliance checklists, alerts, regulatory summaries, certificates, and integrations with third-party property management systems. The Service is provided for informational purposes only.
HostReady is not a law firm, tax advisor, or government agency, and it does not provide legal, regulatory, or tax advice. Information presented through the Service may not reflect the most recent legal or regulatory developments in every jurisdiction. Nothing in the Service creates an attorney-client or other professional relationship. You remain solely responsible for verifying compliance requirements with local authorities and for adhering to all applicable laws and regulations.
Compliance rules, license requirements, fees, fines, zoning, and tax obligations change frequently and differ by jurisdiction. HostReady does not warrant that any data, score, checklist, certificate, alert, or other output is accurate, complete, current, or suitable for your particular situation. You must independently verify all information with the applicable authorities before relying on it.
You acknowledge and agree that you are solely responsible for the legality, licensing, registration, taxation, and operation of your properties, and that you assume all risk associated with operating a short-term rental. HostReady is not responsible for any fines, penalties, back taxes, interest, enforcement actions, license denials or revocations, permit issues, property shutdowns, lost revenue, or other losses or damages arising from your use of, or reliance on, the Service.
Certain features require an account. You agree to provide accurate information, keep it current, and maintain the confidentiality of your credentials. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Certain features require payment of subscription fees or one-time fees. Payments are processed by third-party payment processors, and we do not store complete payment card information. Subscriptions renew automatically for successive periods at the then-current rate unless cancelled before the renewal date. You may cancel at any time, effective at the end of the current billing period. Except where required by law, fees are non-refundable, and partial periods are not prorated. We may change pricing on a going-forward basis with notice.
If you connect a third-party property management system (such as OwnerRez, Hostfully, or Track), you authorize HostReady to access that account on your behalf to import property and owner data, and you represent that you have the authority to grant that access. These connections are read-only, and HostReady does not create, update, or delete data in your connected account. HostReady is not responsible for the availability, accuracy, security, or policies of any connected third-party system, or for any acts or omissions of those providers. You may disconnect a connected system at any time.
You agree not to misuse the Service. Prohibited activities include, without limitation, reverse engineering the platform, interfering with its operation or security, scraping or extracting datasets, reselling or redistributing the Service or its data without authorization, or using the Service for any unlawful purpose.
All content, software, databases, algorithms, models, and compliance frameworks provided through the Service are the exclusive property of HostReady or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes, subject to these Terms. You retain ownership of the data you submit, and you grant us a license to use that data to provide and improve the Service.
The Service uses artificial intelligence to generate compliance summaries, regulatory insights, and recommendations. AI-generated outputs may contain inaccuracies, outdated information, or incomplete interpretations of regulatory requirements. You should independently verify all outputs before relying on them.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, HOSTREADY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING ACCURACY, COMPLETENESS, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. HostReady does not warrant that the Service will meet your requirements or that any compliance outcome will be achieved.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOSTREADY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO THE SERVICE, INCLUDING ANY FINES, PENALTIES, TAXES, ENFORCEMENT ACTIONS, OR LICENSING ISSUES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL HOSTREADY'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO HOSTREADY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless HostReady and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your properties or their operation, your violation of these Terms, your violation of any law or regulation, or your infringement of any third-party right.
The Service may rely on or integrate with third-party infrastructure, payment processors, property management systems, and other services. HostReady is not responsible for the actions, availability, accuracy, or policies of any third-party provider.
We may modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Subject to Section 17, the state and federal courts located in Colorado will have exclusive jurisdiction over any dispute not subject to arbitration.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us. Except for claims for injunctive relief or intellectual-property claims, any dispute arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. YOU AND HOSTREADY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If this class-action waiver is found unenforceable, the remainder of this Section will be severed.
HostReady is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, outages, third-party service failures, labor disputes, or governmental action.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and HostReady regarding the Service and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent, and we may assign them freely. These Terms do not create any third-party beneficiary rights.
HostReady Autopilot is an optional, paid service in which HostReady prepares your short-term rental license, registration, and renewal filings, and, where the jurisdiction permits, submits them as your limited agent, using the information and documents you provide and authorize. Autopilot is separate from the informational Service and is governed by these Terms together with the per-property authorization you sign when you enroll.
You remain the filer of record. You are responsible for the accuracy and completeness of the information and documents you provide, for any required notarization or signature, for any required inspection, and for satisfying the conditions the authority imposes. In many jurisdictions the final submission is made by you, from your own account on the government portal; HostReady prepares the filing and provides a direct link. HostReady acts only on what you supply and does not independently verify your eligibility to operate.
Authorization and revocation. Before HostReady prepares or submits a filing on your behalf, you authorize it for the specific filings and property named in the authorization. That authorization is limited to those filings, grants HostReady no authority over your finances or property, and may be revoked by you in writing at any time; revocation does not affect filings already submitted.
Government fees. Government filing fees are your responsibility and are paid by you directly to the authority. HostReady does not advance government fees and charges no markup on them. HostReady's Autopilot fee is for the preparation and handling service only and is separate from any government fee.
Availability and no guarantee. Autopilot is available only for supported jurisdictions and eligible plans; where HostReady does not yet support a jurisdiction, that property cannot be enrolled. HostReady does not guarantee that any filing will be accepted or approved, and is not a law firm and does not provide legal advice. Preparing and submitting forms from the information you provide is an administrative service, not the practice of law.
Fees, renewal, and cancellation. Autopilot fees are billed as disclosed at enrollment and, for recurring plans, renew automatically unless cancelled before the renewal date. You may cancel at any time, effective at the end of the current term. Except where required by law, Autopilot fees are non-refundable. The disclaimers, assumption of risk, and limitation of liability elsewhere in these Terms (including Sections 3, 10, 11, and 12) apply fully to Autopilot.
We may update these Terms from time to time. Material changes will be reflected by the “Last Updated” date above, and your continued use of the Service after an update constitutes acceptance of the revised Terms.
