If you run a short-term rental in unincorporated Jefferson County, a sweeping land use overhaul is heading toward a vote before the end of 2026, and STRs are explicitly named in the draft. The proposed Unified Land Use Code, known as the ULUC, would consolidate and replace the county's existing patchwork of zoning and development rules with a single enforceable document. Hosts who assume the current rules are permanent should think again.
What the ULUC Is and Why It Matters to Hosts
Jefferson County's goal is straightforward: replace several overlapping regulatory documents with one clearer code. The ULUC addresses zoning, subdivisions, setbacks, parking, landscaping, water, fire protection, ADUs, and short-term rentals. That last item is not a footnote. STRs are listed alongside the county's most consequential land use categories, which means the rules governing where and how you can operate a rental could change when the code takes effect.
The ULUC applies only to unincorporated Jefferson County. Incorporated cities maintain their own separate zoning regulations and are not affected by this process.
The Dates That Actually Matter
The county has set two critical hearings. The Planning Commission is scheduled to hear the ULUC on November 18, 2026, at 6:15 p.m., with a possible continuation on November 19. The Board of County Commissioners then takes it up on December 15, 2026, at 9:00 a.m., with a possible continuation on December 16. The Commissioners will ultimately decide whether to adopt the ULUC and the proposed zoning map.
The county still accepts public comments, but staff has said those comments will not change the draft before the hearings. That makes showing up to the hearings, or submitting written testimony before them, the last real opportunity for hosts to influence the outcome.
What Hosts Are Already Required to Do
While the ULUC is still being finalized, the county's existing STR rules are already in force and carry real requirements. Hosts in unincorporated Jefferson County must hold a hospitality permit for a short-term rental, and the property must be a primary residence. Rentals are capped at 10 guests, and parking must be provided on site. An inspection is required before you can legally operate.
Occupancy is not simply a headcount. The county ties maximum rental capacity directly to septic capacity. Each bedroom in a house is allocated 120 GPD and has the capacity for 2 people. A two-bedroom septic system, for example, carries 240 GPD and allows up to 4 guests at one time. Hosts with larger guest counts need to verify their septic rating, not just their bedroom count.
On taxes, Airbnb collects and remits lodging tax on your behalf, but manual tax submission is still required. Do not assume platform collection covers every obligation.
The Zoning Wildcard
The ULUC is not just a consolidation. It makes significant policy changes, including expanding housing types in residential districts and introducing new zoning categories. The zoning map matters as much as the written code, because where your property lands on that map determines what uses are allowed by right. STR-friendly zoning today is not guaranteed to survive the reclassification process.
The ULUC also moves more decisions to administrative staff rather than public boards. Proposed setbacks can receive reductions of up to 50 percent through administrative exceptions, and parking requirements can be reduced by up to 50 percent as well. That flexibility cuts both ways: it could ease some compliance burdens, but it also means fewer automatic public hearings where neighbors or hosts can weigh in.
What Hosts Should Do Right Now
- Confirm your hospitality permit for a short-term rental is current and your property qualifies as a primary residence.
- Verify your occupancy limit against your septic capacity, not just your bedroom count.
- Check that your property's current zoning is STR-compatible and watch for how the proposed zoning map reclassifies your parcel.
- Submit written comments or attend the Planning Commission hearing on November 18, 2026, if you want your voice in the record before the Commissioners vote.
- Confirm your manual tax filing obligations even if Airbnb collects lodging tax on your behalf.
